As a minor in New York, can you consent to vaccinations?

 

The actual law:

“When a health care provider diagnoses, treats or prescribes for a minor, without the consent or knowledge of a parent or guardian as permitted by section 2305 of the Public Health Law, neither medical nor billing records shall be released or in any manner be made available to the parent or guardian of such minor without the minor patient’s permission. In addition to being authorized in accordance with section 2305 of the Public Health Law to diagnose, treat or prescribe for a person under the age of 18 years without the consent or knowledge of the parent or guardian of such person where the individual is infected with a sexually transmitted disease, or has been exposed to infection with a sexually transmitted disease, health care practitioners may (as authorized by their scope of practice) render medical care related to other sexually transmitted diseases without the consent or knowledge of the parent or guardian.”

10 N.Y.C.R.R. § 23.4

“Section 23.4 of Title 10 NYCRR now allows health care providers to ‘…render medical care related to other sexually transmitted diseases without consent or knowledge of the parent or guardian.’....Under this regulatory change, health care providers are also permitted to provide human papillomavirus (HPV) vaccination to sexually active minors without parental/guardian consent.”

What this means:

In New York, minors of any age do not need their parent’s consent to receive the Human Papillomavirus (HPV) vaccine. They still must have parental consent to receive all other vaccinations.

Note: Minors can receive some health care services without parental consent in Title X-funded clinics. Call a nearby clinic to see if they will administer vaccinations without parental consent or your state health department for more information.

While minors can only currently receive the HPV vaccine without parental consent in this state, there are two sets of concurrent Senate and Assembly bills expanding minors’ ability to self-consent to vaccinations.


S03041/A03192: Allows minors who are 14 years old or older to self-consent to all recommended vaccinations.
